Client Terms

The short version

  • Month-to-month. No long-term contract.
  • Paid in advance. Late payment delays work.
  • Minimum 45 days’ written notice to cancel a monthly plan.
  • No refunds and no returns.
  • Ad spend goes to Google, not to us.
  • No guaranteed results.

These terms apply to every project and monthly plan with In-Touch Marketing LLC. They sit alongside your signed proposal or agreement. If the two disagree, your signed agreement wins.

How does billing work?

We invoice through Stripe. Audits, content plans and Fix Sprints are paid in full before we start. Web design projects take a 50% deposit to start and the balance before launch.

Monthly plans are billed in full and paid in advance, on the same day each month. A delayed payment stalls work until it’s resolved.

When you pay your first invoice, you authorize us to charge the same card or bank account for each later invoice under your plan. To update your payment method, email us.

What is your refund policy?

We don’t offer refunds. We start putting hours, research and expertise into your project the day you pay, and we can’t take those back.

This covers audits, content plans, Fix Sprints, setup fees, design deposits and monthly fees. It doesn’t cover ad spend, because Google holds that money, not us.

If you’re unhappy with how things are going, tell us. We’ll adjust the next month’s priorities. And you can cancel a monthly plan at any time with 45 days’ written notice.

Do you accept returns?

No. We sell services, not physical products, so there’s nothing to return.

How do I cancel a monthly plan?

Cancellation requires a minimum of 45 days’ written notice. Email support@in-touchmarketing.com with the subject line “Cancel my plan.” We’ll confirm by email.

How do you decide what to work on each month?

Your monthly plan buys our time and expertise at the level of your plan. It doesn’t buy a fixed count of items.

Each month we divide your plan’s hours and deliverables between content, technical SEO and links, based on what your site needs most. One month may lean toward links and the next toward technical fixes. Your monthly report shows what we did.

How do content approvals work?

We send your content for review before it goes live. You have 5 business days to approve it or request changes. If we don’t hear back within 5 business days, we publish it as sent.

What about my ad spend?

Ad spend is the money Google charges for your ads. You pay Google directly from your own Google Ads account. We never hold your ad budget.

Our management fee is separate from ad spend. Google’s billing terms cover ad spend, including any credits or disputes.

Do you guarantee results?

No. Nobody can honestly promise rankings, traffic, AI mentions, calls or sales, because Google, ChatGPT and other platforms make those decisions and change them without warning. AI answers also vary from one run to the next.

What we do promise: we do the work in your plan, report on it plainly every month, and tell you what we see.

Do you handle patient or health information?

No, and we don’t want it. Our work doesn’t require patient names, records or other protected health information. Please don’t email it to us or put it in shared documents.

If your site collects patient information through forms, booking tools or call tracking, tell us before we install any analytics or advertising tags. We’ll work with your compliance team on what’s safe to track.

What do you need from me?

We need access and honest answers. Please give us:

  • Access to your website, Google Analytics, Search Console, Google Business Profile and ad accounts
  • Accurate information about your business, services and prices
  • Content, photos and logos you have the right to use

What if the scope changes?

If you want work that isn’t in your proposal, we’ll quote it in writing before we start. Fixed-price work stays at the fixed price unless you approve a written change.

How do audits work?

Your audit starts once we’ve received payment and access to your accounts. Audits typically take 7 to 14 business days, followed by a walk-through call.

The audit is a snapshot of the day we reviewed your site. Every monthly plan begins with an audit.

What happens if a payment fails?

We’ll email you and retry the charge. Work may slow or pause until the payment goes through.

How do you handle confidentiality and my data?

We keep your business information, login details and reports confidential. We use your access only to do your work.

We never publish your name, results or testimonial without your written permission. Our Privacy Policy explains how we handle personal information.

What are the limits of your liability?

Our total liability for any claim related to our services is limited to the fees you paid us in the three months before the claim. We aren’t liable for lost profits, lost revenue or indirect damages.

How do we resolve a disagreement?

Email us first at support@in-touchmarketing.com. We’ll work with you in good faith for 30 days to resolve it. These terms are governed by California law. A dispute we can’t resolve goes to the courts of San Diego County, California.

Can these terms change?

Yes. We post every change here with a new “last updated” date. For current clients, we email 30 days before a change takes effect. The version in effect on the day you signed or paid governs your project unless you agree to a newer one.
